1. Who these terms are between

These terms are between you (the customer) and Novianweb, operating as Novianweb, of Philadelphia, TN, United States. They apply when you buy any service from us.

2. What we provide

We provide website design and build services, ongoing website maintenance, and an AI receptionist chat service, as described on our services page and in the written quote we give you. The quote is what governs your specific project.

3. Prices and payment

All prices are in USD (US Dollars). A Website Build is $750, and the Website Care Plan is $49 per month. The AI Receptionist is quoted per business in writing before any charge is made.

A 50% deposit is due before work begins. The balance is due when the site is approved and launched. Monthly services are charged on the same day each month until cancelled.

Payments are processed by Stripe. By paying, you authorise the charge described at checkout. Recurring charges continue until you cancel.

4. What we need from you

To build your site we need your business information, photos, and timely responses to questions. If we cannot reach you for 30 days during an active project, we may pause the project and invoice for work completed to that point.

You confirm that any text, photos, or logos you give us are yours to use, or that you have permission to use them.

5. Revisions and scope

A Website Build includes two rounds of revisions before launch. Additional revisions, added pages, or work outside the written quote are quoted separately and only begin once you approve the price in writing.

6. Ownership

Once your project is paid in full, you own your website's content, design, and domain name. We retain ownership of the underlying templates and tools we reuse across customers. If you leave, we hand over your site files and transfer your domain at no charge.

7. Hosting and uptime

Websites are hosted on Cloudflare's infrastructure. We aim for continuous availability but do not guarantee uninterrupted service, and we are not responsible for outages caused by hosting providers, domain registrars, or other third parties outside our control.

8. The AI Receptionist

The AI receptionist generates responses automatically and can make mistakes. It is a convenience for answering common questions, not a substitute for you. It is not configured to give legal, medical, or financial advice, quote binding prices, or accept payments. You are responsible for what it is configured to say on your behalf and for reviewing the leads it produces.

9. Cancellation and refunds

Covered in our Refunds and Cancellations policy, which forms part of these terms.

10. Acceptable use

We do not build or host sites for illegal activity, adult content, gambling, weapons sales, or anything designed to deceive people. We may decline or end work that falls into these categories, refunding any unearned payment.

11. Limitation of liability

Our total liability for any claim relating to our services is limited to the amount you paid us in the twelve months before the claim. We are not liable for lost profits, lost business, or indirect damages. Nothing here limits liability that cannot be limited by law.

12. Availability

We sell to customers in the United States only. There are no export restrictions applicable to these services.

13. Governing law

These terms are governed by the laws of the State of Tennessee, United States.

14. Changes to these terms

We may update these terms. The version in effect when you paid governs your purchase. For monthly services, we give 30 days' notice by email before changes take effect, and you can cancel at any time.
